<P>Hi, I am Saul Carter right here with Others Realty. We are considered one of Modesto&#8217;s main short sale teams. I needed to talk about cooperative short sales today. I&#8217;ve had a couple of purchasers in the past few months come to me and say they had this agent contact them on behalf of their financial institution, whether or not it is Bank of America or GMAC or different banks as well. They want to do a short sale and they&#8217;re being prompted by the bank. It is all well and good, the brokers honestly they&#8217;re attempting to get extra business and if they will get referrals from banks, more power to them. I&#8217;ve one problem with that although, there is a bit of a conflict of interest. If I get all my business from a financial institution, and I am in the middle of a short sale negotiation, and I know that I cannot obtain any more business from that bank if I don&#8217;t make it possible for I keep them comfortable, who am I actually representing? Am I representing the seller or am I representing the bank?<br />
<P>Now legally I have a fiduciary responsibility to the seller, which implies I have to act within the seller&#8217;s best interest in all things. I should not have a fiduciary responsibility to the bank except after all I have established one through some sort of contract. Either way, that may be a large conflict of interest and I do not assume that you can actually symbolize your seller appropriately and by law if for some purpose you have got some kind of hidden and or disclosed relationship with the financial institution that&#8217;s supplying you with referrals for cooperative short sales.<br />

Today I would like to talk to you about different real estate designations, which are basically the various letters and abbreviations that real estate agents have behind their names.<br />
<P>As I mentioned in a previous video, we have recently finalized our 76th short sale. What&#8217;s exciting about that is when you complete your 75th short sale transaction, you achieve a higher designation. As a realtor, there are many opportunities for us to achieve different designations by going to workshops and taking educational classes. One of the major reasons I received my broker&#8217;s license is because it gave me a higher level of education over being a regular salesman.<br />
<P>I also have a short sale designation which is a short sale genius diamond. This is the level that I just received upon finalizing my 75th short sale. What&#8217;s nice about the designation that I have is that I&#8217;m not just going to a class for a few hours and then taking a test; I am getting short sale experience while trying to gain a higher designation. With the short sale genius designation there are essentially two part: a continuing education forum that occurs on a weekly basis and then there is the number of short sales that you have closed. There are some designations available, like the CEPE and the SFR, that I don&#8217;t really agree with after having completed so many short sales on my own.<br />
<P>At the end of the day, I feel as if there&#8217;s no better way to gain a designation than completing short sales. I have included this loan modification waiver document to avoid this type of mix-up in the future; this also helps if you have been doing a loan modification and notifies the bank in writing that you do not want to proceed with the loan modification any longer and are going to do a short sale.
